What a French court referral means
In French procedure, défèrement is the child’s physical presentation to the public prosecutor after the police measure ends. It is not a conviction and is not, by itself, the hearing that determines guilt. It enables the prosecutor to decide whether the investigation continues, how the case is routed and whether any interim measure will be requested.
The transfer from the police station to the court happens quickly. Preserve the exact chronology of custody, every rights form provided and any information given about the transfer. Any difficulty during the police measure should be raised with the lawyer immediately.
The presentation before the prosecutor
The legal representatives and the person or service responsible for the child must be notified. The prosecutor requests a short social and educational assessment and, if no lawyer has been chosen, asks for duty counsel to be appointed. The lawyer may inspect the case file immediately and speak with the child in private.
In the lawyer’s presence, the prosecutor confirms identity, states the allegations and their legal classification and explains the choice to make a statement, answer questions or remain silent. The lawyer may then comment on procedural regularity, classification, any missing investigative steps and the possible form of prosecution.
Understanding the proposed route
After hearing the observations, the prosecutor may continue the investigation, refer the case to a trial court or request a judicial investigation. If a hearing is fixed, identify the court, the type of hearing, the allegations, the date and the stages that may follow.
Where the prosecutor seeks a measure before trial, a separate hearing may take place before the juvenile judge or, in specified cases, the liberty and custody judge. Depending on age and procedural route, the request may involve an interim educational measure, judicial supervision, electronic monitoring or, where the strict legal conditions are met, pre-trial detention.
Preparing useful social and educational information
The short social and educational assessment should give the court an up-to-date view of the child’s circumstances. Representatives can gather identification, proof of address and accommodation, school or employer contact details, timetables, educational or medical support and the names of adults able to provide practical supervision.
A credible proposal identifies who will house the child, who will ensure attendance at appointments, how education will continue and how any restrictions on contact or movement can be observed. General assurances carry little weight: each commitment should be dated, signed, verifiable and workable in daily life.
Before leaving the court building
Read the referral record, summons and any order that is provided. Check the hearing date, time and place, obligations taking effect immediately, the educational service to contact and the appeal information. A copy of the prosecutor’s referral record is provided to the child where the prosecutor seises the trial court.
The representatives should leave with a clear list of the next deadlines and any documents still required. Immediate compliance with an interim order does not prevent its legal basis from being challenged or an appeal from being filed; it avoids an additional breach before the hearing.
Discuss your situation
You can send the firm the essential facts, relevant dates and any known deadline.
Frequently asked questions
Does referral mean that the child has already been found guilty?
No. The prosecutor decides how the case should proceed and may seise a court or request an interim measure. Guilt will be determined later by the competent court unless the case is disposed of in another way.
Does the lawyer take part before the prosecutor?
Yes. The child is assisted by a lawyer, who may inspect the file immediately, communicate with the child and make observations before the prosecutor decides what happens next.
Are the legal representatives informed?
Yes. The prosecutor must notify them and the person or service responsible for the child. They may also be heard at a hearing on an interim measure and must receive the necessary information about the decision.
