Foreign minors in France

For a foreign child in France, three questions should be separated at once: protection as a child, evidence of age and identity, and the steps to prepare before adulthood. A person under eighteen cannot be made subject to an OQTF, but that protection does not by itself resolve their future immigration position.

Protection owed to a child

Article L. 611-3 CESEDA excludes an OQTF against a foreign national under eighteen. Other issues may still arise, including child protection, travel documentation and the family’s position.

An unaccompanied child or a child at risk first falls within the protection system. Emergency reception, assessment and, where needed, referral to the juvenile judge should be considered without waiting for a residence procedure.

Assessment of an unaccompanied minor

The assessment under Article R. 221-11 of the Social Action and Families Code must be multidisciplinary, conducted in a language the child understands and based on a range of factors. It follows a respite period within emergency provisional reception.

A refusal of care must be formalised. The interview conditions, interpreting, reasons and documents considered should be retained for any challenge.

Evidence of identity and history

Collect civil-status and identity documents, school and health records, placement or training documents, and material explaining the journey and family links. No single document should be detached from the overall chronology.

Differences in dates, spelling or accounts should be explained with concrete evidence. Preserve originals and keep a record of verification or legalisation steps where required.

Prepare for adulthood

Child protection and the future right to reside are governed by different criteria. Several months before the eighteenth birthday, review the possible residence basis, deadlines, school or training history and available identity evidence.

Depending on the circumstances, a child may also need a DCEM travel document. It can facilitate re-entry to France after travel but is not a residence permit.

Counsel’s role

Counsel separates urgent protection issues, any challenge to the age assessment and administrative preparation before adulthood. She reviews decisions, organises the evidence and seises the competent authority or judge.

Nationality, time in care or school attendance does not create an automatic result. The route must be built from the child’s actual circumstances.

Frequently asked questions

Can a child receive an OQTF?

No. Article L. 611-3 CESEDA prevents an OQTF being made against a foreign national under eighteen. Protection and preparation for adulthood still require separate attention.

What if the claimed age is rejected?

Obtain and keep the reasoned decision, assessment conditions and list of documents considered. Gather original civil-status papers and consistent evidence of the child’s history immediately.

Is a DCEM a residence permit?

No. Subject to its conditions, the travel document helps a foreign minor re-enter France after travel; it does not replace a residence permit at adulthood.
